Where the dates come from

Rule 68B-24.005 of the Florida Administrative Code sets both seasons. The regular season “shall be August 6 of each year through March 31 of the following year”, and the sport season, the “mini-season” for recreational divers, “shall occur during the last Wednesday and successive Thursday of July each year”. FWC reads that as the “last consecutive Wednesday and Thursday of July”, both days in July: in 2024, when July 31 fell on a Wednesday, the mini-season was July 24 and 25. Between them the season is closed, and from April 1 to August 5 the rule forbids even having a lobster “regardless of where taken”.

The Keys’ own limits

The mini-season limit is 12 lobsters a person a day in most of Florida, but 6 “for Monroe County and Biscayne National Park” (FWC). On the second day you may have twice the limit once ashore: 24 outside the Keys, 12 in Monroe County and in Biscayne National Park. In the regular season the limit is 6 a person everywhere. In Monroe County during the mini-season, no one may take lobster “by diving at night (from 1 hour after official sunset until 1 hour before official sunrise)”; on July 28, 2027 in Key West that is 9:13 PM to 5:54 AM. John Pennekamp Coral Reef State Park is closed to lobster for the whole mini-season, and in the regular season no lobster may be taken from its patch reefs. At all times FWC lists as closed “Everglades National Park, Dry Tortugas National Park, no-take areas in the Florida Keys National Marine Sanctuary”, the Biscayne Bay/Card Sound Lobster Sanctuary and “the five Coral Reef Protection Areas in Biscayne National Park”.

A lobster’s carapace must be “larger than 3 inches, measured in the water”, and a diver must carry a gauge. Common mistakes

  • Counting the last Wednesday of July when it is July 31. FWC holds the mini-season on the last Wednesday and Thursday that are both in July.
  • Taking 12 in the Keys on a mini-season day. Monroe County and Biscayne National Park allow 6.
  • A night dive in the Keys during the mini-season. It is banned from an hour after sunset to an hour before sunrise.
  • Diving John Pennekamp in late July. The park is closed to lobster for the whole mini-season.
  • Forgetting the $5 permit. The fishing license alone is not enough.
  • Wringing the tail off on the boat. Lobsters stay whole until you are ashore.
