Short answer: yes, until 10 p.m. Miami Beach’s city code closes the beach from 10 p.m. to 5 a.m., so an evening walk on the sand is fine, but a midnight one isn’t.
Before 10, the rules are simple: no alcohol, no glass, and no dogs outside the designated dog areas.
After 10, walk Ocean Drive or Lincoln Road instead.
I rewrote this page in October 2026.
The old version said “Yes, you can absolutely walk on Miami Beach at night!” and never mentioned the 10 p.m. closing.
It also said dogs could join you on the beach from 5 p.m. to 9 a.m. They can’t.

The 10 p.m. rule
Here’s the line, straight from section 82-2 of the Miami Beach city code: no person shall “be or remain in any public beach not fenced in or provided with gates, between the hours of 10:00 p.m. and 5:00 a.m. on the following day.”
It used to be later.
In October 2017 the city commission voted to close the beach east of the dunes two hours earlier, at 10 p.m., after a run of violent crimes and thefts late at night.
The beach still opens at 5 a.m.
A few details worth knowing:
- Parks that aren’t gated close from midnight to 5 a.m. You can still pass straight through one on the most direct path to your exit.
- Police and park staff on duty, and anyone with a written permit, are exempt.
- The city manager can set exceptions to the closing hours, and they have to be posted. So the hours can change, but only with a posted notice.
Honestly, 10 p.m. still leaves me plenty.
In my book, sunset to 10 is the good part anyway.
What’s banned on the beach, day or night
The city says alcohol and smoking are always prohibited on its beaches.
Its list of things always banned on the sand also includes cigarettes, coolers, inflatables, tents or tables, loud music, glass containers, and Styrofoam, plastic straws and balloons.
So no bottle of wine at sunset, sorry.
I’d save it for dinner.
Dogs are the other one people get wrong.
City code bans animals on public beaches except in areas set aside for dogs.
The code names two spots where a dog can run off-leash:
- North Shore Open Space Park, in the beach area between 80th and 82nd Streets, from 3 to 7 p.m. Friday through Sunday.
- South Pointe Park, in the area south and west of the Washington Avenue entry plaza, from sunrise to 10 a.m. daily, and 6 to 9 p.m. Monday through Friday.
Get caught with an unleashed dog anywhere else and the fine is $250 the first time, $500 the second and $1,000 after that (within 12 months).
Service dogs are excluded from the beach ban.

Start on the sand for sunset (check tonight’s sunset time).
Walk it until it gets dark.
Then head one block inland.
Ocean Drive runs from South Pointe, just south of 1st Street, up to 15th Street.
It’s known for its Art Deco hotels and its restaurants and bars, including the 1939 Colony Hotel, billed as the most photographed Art Deco hotel.
Mango’s Tropical Café is there too, with live dancers and singers, if you want the loud version of the evening.
Lincoln Road Mall is the calmer pick.
It’s a pedestrian road between 16th and 17th Streets, lined with shops and restaurants plus galleries, and it’s where I’d walk after dinner.
My kind of place: you can wander without a plan.
If jet lag has you wide awake at 1 a.m., stay on those streets.
The sand is closed, and the city closed it early for a reason.
Spring break is its own thing
Every Thursday through Sunday in March 2026, the city cut Ocean Drive’s beach entrances to six (5th, 7th, 8th, 10th, 12th and 14th Streets) and ran security checkpoints for banned items.
If you’ve booked a March trip, check the city’s beach rules page before you go.
